Stopping a foreclosure in New York

There is no single lever. There is a set of specific mechanisms, and which of them is available to you depends almost entirely on how far the case has already gone.

No one can promise a foreclosure will be stopped

The honest version
of the answer.

Search results for this question are full of promises. The useful answer is duller and more specific: here is what exists, here is what each one requires, and here is when it stops being available.

New York is a judicial foreclosure state. A lender has to bring a case, serve you, and get a judgment before a sale can happen. That means there are defined points where something can be done, and defined points after which it cannot.

What nobody can tell you from a web page is which of these fits your situation. That depends on your loan, your income, the notices you received, how you were served, and how much time is left. It is the reason the first useful step is working out exactly where you are.

One thing to be clear about

No attorney can promise a foreclosure will be stopped or delayed, and only a lender or servicer can approve a loan modification. Anyone guaranteeing either is selling you something they do not control.

First, locate yourself

Which question are you actually asking?

These three positions have different answers, and mixing them up is why general advice about foreclosure so often does not fit.

  1. 01

    No case has been filed

You are behind, or notices have arrived from the servicer, but nothing has come from a court. The widest set of ordinary options is open: reinstatement, loss mitigation, a normal sale.

    Pre-foreclosure

  2. 02

    A case is running

You were served with a summons and complaint. Now there are deadlines: an answer, and a mandatory settlement conference the court must hold within 60 days of proof of service being filed.

    In litigation

  3. 03

A judgment or a sale date exists

The court has directed a sale, or a date has been published. The routes narrow sharply here, and the sale date becomes the deadline everything is measured against.

    Late stage

The inventory

What actually exists, and what each one needs.

Six mechanisms. None of them is automatic, all of them have requirements, and several of them expire.

Reinstatement and payoff

Reinstating means paying the arrears, late charges and advances to bring the loan current. Paying off means clearing the balance, usually through a sale or a refinance.

Simple to describe, hard to fund, and generally available for longer than people assume. Ask your servicer in writing for both quotes with a good-through date, because the numbers move.

Loss mitigation

A repayment plan, forbearance, deferral, modification, short sale or deed in lieu, depending on the loan and who owns it. Only the lender or servicer can approve any of them.

Federal servicing rules attach real consequences to a complete application. Where one is submitted more than 37 days before a scheduled sale, the servicer may not move for a foreclosure judgment or an order of sale, or conduct the sale, while it is pending. Complete is the operative word, and it is the part you control.

Answering the complaint and raising defenses

If a case has been filed, filing an answer is how you stay in it. The deadline is 20 days if you were personally served in New York, and 30 days if you were served any other way.

Defenses in New York foreclosure cases commonly involve whether the required pre-foreclosure notices were properly sent, whether the plaintiff has standing to sue, whether service was proper, and whether the amount claimed is right. Whether any of these are in your case is a question about your file.

The settlement conference

Every residential foreclosure case in New York gets a mandatory settlement conference, held within 60 days after proof of service is filed. Both sides must negotiate in good faith and a court can impose sanctions where they do not.

It is the structured opportunity to resolve the case, and it is supervised. It does not, however, pause your deadline to answer.

Payment into court under RPAPL 1341

Where part of the mortgage debt is due and part has not yet come due, a defendant who pays into court the amount due with interest and costs can ask the court to dismiss the complaint, if that happens before a judgment directing sale, or to stay all proceedings, if it happens after judgment and before the sale.

Narrow, specific, and dependent on the structure of the debt and the timing. It is a question for an attorney with the file, not a general plan.

The things people ask about that are not on this list

Bankruptcy is a significant step with consequences well beyond the mortgage, and whether it fits depends on your income, your other debts and your goal for the property. It is a conversation with a lawyer who has seen your whole position, not a tactic to pick off a list.

Selling to a company that promises to let you stay, or paying an up-front fee to have a foreclosure stopped, is where New York homeowners in this position get hurt. New York regulates distressed property consultants for that reason. Have any written offer reviewed by someone with no stake in it.

When it ends

The foreclosure sale terminates the right of redemption, and New York does not give a homeowner a period after the auction to buy the property back.

That is the hard deadline in a New York foreclosure. Everything above is worth more the further you are from it.

This page describes general New York foreclosure procedure. It is not legal advice, and procedure has exceptions, county practice and case law that no general page can apply to an individual situation. NewYorkForeclosureHelp.com is not a law firm, a lender, or a government agency. If a deadline, court date, or sale date is approaching, speak with an attorney promptly.

Who to call first

A counselor or an attorney?

Both are real options and they are not competitors. Which one to start with depends mostly on whether a court is involved yet.

Common questions

What people want to know.

When is it too late to stop a foreclosure in New York?

The foreclosure sale is the practical end: it terminates the right to redeem the property, and New York has no redemption period afterward. Before the sale, what is available narrows at each stage, from reinstatement and loss mitigation before a case is filed, to answering and the settlement conference once one is, to court applications and payment into court after judgment. Late is worse than early at every stage, but until the sale has happened the question is which mechanism still fits, not whether all of them are gone.

Does filing bankruptcy stop a foreclosure in New York?

Filing a bankruptcy case triggers an automatic stay under federal law that pauses collection activity, including a scheduled foreclosure sale, while it is in effect. It pauses the case; it does not resolve the mortgage, and the stay can be lifted on the lender’s motion. Chapter 13 plans are sometimes used to catch up arrears over time. Bankruptcy has consequences well beyond the mortgage, so it is a decision for a lawyer who has looked at your whole position, not a tactic to pick off a list.

Can a foreclosure actually be stopped?

Foreclosure cases in New York end in many ways: reinstatement, a modification, a short sale, a dismissal, a settlement, a discontinuance. Whether anything is available in a particular case depends on the facts and the stage. No one can promise a result, and a promise is a reason to be careful about who is making it.

What is the latest I can do something?

The practical deadline is the foreclosure sale, because the sale terminates the right to redeem and New York has no redemption period afterwards. Options narrow well before that, so late is worse than early at every stage.

Does filing something with the court delay the sale?

Not automatically. Applications for a stay exist, and paying into court under RPAPL 1341 can stay proceedings in the circumstances that statute describes. Whether either is available to you is a question about your case file.

Will submitting the form on this site stop anything?

No. Submitting a request does not stop a sale, pause a case, or extend a deadline. It connects you with an attorney for a free evaluation. If a date is close, say so at the start of the conversation.

Someone offered to buy my house and rent it back to me.

Treat that with real caution. New York regulates distressed property consultants and sale-leaseback arrangements because homeowners in exactly this position have lost both the house and the equity. Have any written offer reviewed by an attorney with no connection to the person offering.
